These Terms of Service ("Terms") govern access to and use of the Plateon platform and related websites and services (collectively, the "Service") operated by Plateon("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Plateon is a business-to-business (B2B) software-as-a-service platform for restaurants and similar hospitality businesses. The Service may include, depending on your subscription plan: a hosted digital menu and storefront on a Plateon subdomain, menu management tools, multi-language storefront features, QR-based table ordering, order management, table booking and reservations, analytics, and AI-assisted menu import. Features available to you depend on your active plan.
2. Eligibility and accounts
The Service is intended for business use by restaurant owners, operators, or authorized staff. You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account.
3. Subscriptions and payment
Paid plans are offered on a recurring subscription basis (monthly or annual) in EUR. Checkout and billing are processed by Paddle.com Market Ltd and its affiliates ("Paddle"), who act as merchant of record for subscription charges. Your purchase is also subject to Paddle's checkout terms and policies where applicable.
Fees are charged in advance for each billing period. Plan changes, renewals, cancellations, and tax treatment are handled according to your subscription settings in the Service and Paddle's billing records. Pricing and plan features are described on https://plateon.app and may be updated from time to time; changes apply to new billing periods after reasonable notice where required.
4. Your content and end-customer data
You retain ownership of menus, images, branding, and other content you upload ("Customer Content"). You grant us a limited license to host, display, process, and transmit Customer Content solely to operate and improve the Service.
If you use ordering or booking features, you are the controller of personal data relating to your guests (for example names, contact details, or order details). You are responsible for lawful collection, notices, and handling of that data. We process such data on your instructions as a processor where applicable.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or misleading purposes;
- Upload content that infringes third-party rights or contains malware;
- Attempt to bypass security, access other tenants’ data, or disrupt the Service;
- Resell or sublicense the Service except as expressly permitted;
- Use the Service to sell prohibited goods or services under applicable law or payment network rules.
We may suspend or terminate access if you materially breach these Terms or if continued provision poses legal, security, or payment risk.
6. Intellectual property
We own the Service, software, documentation, and branding, except for Customer Content. No rights are granted except as necessary to use the Service under these Terms.
7. Availability and changes
We strive for reliable uptime but do not guarantee uninterrupted or error-free operation. We may modify features, impose reasonable usage limits, or discontinue parts of the Service with notice where practicable. Material adverse changes to paid features during an active paid term will be handled in line with our Refund Policy and applicable law.
8. Disclaimers and limitation of liability
The Service is provided on an "as is" and "as available" basis to the extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our aggregate liability arising from the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (excluding amounts collected by Paddle solely as merchant of record where recovery must be sought from Paddle under their policies).
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited under applicable law.
9. Term and termination
You may cancel a paid subscription according to the billing controls in your dashboard or via Paddle. Cancellation stops future renewals; access typically continues until the end of the current paid period unless otherwise stated in our Refund Policy or required by law.
We may terminate or suspend your account for breach, non-payment, or legal requirement. On termination, your right to use the Service ends; we may delete or retain data as described in our Privacy Policy.
10. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive venue for disputes, unless mandatory consumer or business protections in your country require otherwise.
